StealthGrow specializes in outbound lead generation, cold email campaigns, list building, and related marketing automation.
We may:
Source and verify leads based on your target criteria.
Build and manage outbound email campaigns on your behalf.
Provide consulting, strategy, and infrastructure for outbound prospecting.
We do not guarantee specific business outcomes (e.g., number of sales, closed deals, or ROI) unless explicitly agreed upon in a separate, signed contract.
2. Eligibility
To use our Services, you must:
Be at least 18 years old.
Have the authority to bind your company or organization.
Comply with all applicable laws and regulations, including those governing email outreach, marketing, and data protection.
3. Client Responsibilities
You agree to:
Provide accurate, complete information about your business and target audience.
Ensure your use of our Services complies with all relevant laws (CAN-SPAM, GDPR, CASL, etc.).
Obtain any necessary consents for data you provide to us.
Not use our Services to promote illegal, fraudulent, or harmful products/services.
4. Email Outreach Compliance
We operate in compliance with applicable email marketing and privacy regulations.
While we use best practices to maximize deliverability, we cannot guarantee emails will not be flagged as spam or blocked.
You acknowledge that:
Deliverability can be affected by recipient servers, filters, and other factors outside our control.
You are responsible for the legality of your message content and targeting criteria.
5. Fees & Payments
All fees will be outlined in your Service Agreement or invoice.
Payments are due in advance unless otherwise specified.
Late payments may result in suspension or termination of Services.
All fees are non-refundable unless otherwise stated in writing.
6. Intellectual Property
All materials we create for you (campaign copy, targeting lists, workflows) remain our intellectual property unless otherwise stated.
You receive a license to use deliverables for your internal business purposes.
You may not resell, distribute, or publicly share our work without written consent.
7. Confidentiality
We agree to keep your business information confidential, except when required by law.
You agree not to disclose our proprietary methods, processes, or systems without our consent.
8. No Guarantee of Results
Lead generation and cold outreach involve variables outside our control.
We make no guarantees as to specific results, and past performance is not indicative of future performance.
9. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages, including lost profits or business interruptions.
Our total liability for any claim is limited to the amount you paid for the Services in the 30 days preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
Your use of the Services.
Your violation of these Terms or applicable laws.
Content or data you provide to us.
11. Termination
Either party may terminate Services with written notice per the Service Agreement.
We may terminate immediately if you breach these Terms or engage in prohibited activity.
Upon termination:
All unpaid fees become immediately due.
We may delete your data after 30 days.
12. Changes to These Terms
We may update these Terms from time to time.
The latest version will always be posted on our website with the “Last Updated” date.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
